WHY THE FUCK WOULD THEY WASTE A BULLET ON HIM???? Valuable resource, there. If you're going to be a brutal murderer to protect your own sorry life (can't say I blame you), do it properly and stab him or bludgeon him or something.
Otherwise, you're going to be in a tough situation when his comrades appear and start shooting, and you get all but one of them. One left, and he's got one more bullet than you do.
(Nobody kills anybody, as it turns out. At least, they don't kill him yet. I'm awaiting developments.)
