Don't remember that, but really, pick your battles. Not you, (and not even Apple specifically) just companies in general. They're going to wind up losing that. I mean, can I patent the middle finger salute or something? Can the Boy Scouts patent their boyscout salute? (They would probably win that, actually). How can you patent an ACTION? Sure, it's an action that a company developed so their technology would recognize it, but it's still an action.
