True, but Wisconsin law is quite permissive about self-defense. If you perceive yourself as under attack, _no matter why_ you're under attack (e.g. because you just killed somebody on the street), you're justified in using force to defend yourself.
I presume that reasoning doesn't apply if you're under attack by police officers....
I got the impression from law Twitter that a substantial part of the problem was the prosecutors' incompetence. I really don't see "they did a really piss-poor job, so we'd like to have competent prosecutors retry the case" going down well.
Oh, by the by, it's been suggested that by crossing state lines, Rittenhouse opened himself to federal prosecution. Hoping someone takes a closer look at that idea.
That is a result that I can't find myself surprised by, given what was being reported out of the courtroom about the rulings and decisions during the trial.
It's a petty thing to think about in relation to all of the other, more systemic things that are intertwined in this, but I feel like even the jury there should have been able to accept that bringing the gun meant there was a predisposition to use it - it's not something that can be concealed, after all. And perhaps there is only cold comfort with this, but it also seems like there should be other avenues to pursue, and possibly against the kind of people that leave a gun out that a child can take with them in such a way.
It really seems like yet another case of a white defendant getting privileges and defenses that nobody else would.
