So, hold on. They're going to give up on banning gay marriage EVERYWHERE, but they're now going to make it impossible to appeal against the DOMA (which means that a marriage in one state need not be recognized in another state if it happens to be between two men or two women)?

Evil. Pure evil. And either terribly short-sighted or maniacally clever. The precedent set is unthinkable. We have a constitutional right to petition the government for a redress of grievances. But if one or two laws like this get passed, how long before that right is diluted to nothingness? Precedent is a powerful thing.

Doesn't Canada seem like a lovely place? I hear it rains a lot on the west coast near the border...

Eh.. Canada isn't that great.. Quebec still hasn't signed the damned constitution!

Honestly I'm not too worried about that. Not only is the DOMA clearly unconsitutional, the Marriage Whatever Act is also unconstitutional. The members of the Supreme Court may have their feelings on same-sex marriage, but being barred from hearing a case from the whims of the legislative branch will piss them off. That's why we have checks and balances. When one branch oversteps their boundaries, another branch is there to hit them upside the head and remind them to play nice.

Which is why Bush is so desperate to get his nominees into as many courts as possible instead of the Democrats. Then they would have all 3 branches - executive, legislative AND judicial.

Unconstitutional as becoming a dictator (which I sometimes feel is his ultimate goal). "This law is invulnerable cos you can't appeal against it! Hahaha!" Uh, right.
